BOARD UPDATE & BRADFORD PEAR TREE REMOVAL / REPLACEMENT ESTIMATES ....

1. As of November 1, 2011, our switch to the new management company, Pinnacle Management Group, will be complete. All homeowners should have received a welcome letter from Pinnacle about a week ago. Our new property manager is Andrew Johnson, who can be contacted at 704-542-1940, Ext. 106 if you have any questions.

2. Between October 31st - November 2nd, ten of the community-owned Bradford Pear trees will be removed and replaced. This includes 5 trees on the Castlebay Road bridge, 4 trees near the pool walking bridge, and 1 tree on the corner of Quintrell and Walsham Drives. Irrigation and concrete repairs are planned for completion once these Bradford Pear trees are removed.

3. The Board would like to thank those homeowners who have maintained the yards of others that have not been able to this summer.

The Board has obtained the following Bradford Pear tree removal / replacement estimates that we would like to share with our homeowners. This estimates cover removal of a single Bradford Pear tree, stump, and replanting of a new tree. Labor and materials are included. It should be noted that we have been informed that this price could vary based upon the size of the Bradford Pear tree that is being removed. Homeowners that are interested in participating should contact the below noted companies to arrange removal / replacement directly with them.

MONTHLY BOARD MEETING HIGHLIGHTS - JUNE 2011
1. The tennis court fence repair has been completed. Additionally, the pool gazebo has been power washed and refinished, and five dead trees in common areas have been replaced.
2. Wireless Internet access at the pool has been unavailable for the past few weeks due to problems with the service provider. The service has been restored and is now available again. If you have any problems with this connection, please let us know at lmhoa@landenmeadows.org.

STATEMENT FROM MANAGEMENT
Please be advised that the annual assessment statements recently sent by Superior Management Association, LLC are incorrect. Annual Assessments for 2011 are due March 1, 2011. Accounts will incur a late fee of $39.50 received after March 15, 2011. A corrected invoice will be mailed in the next few weeks.

You may have also noticed the change in Bank and where your payments are sent. CABANC is the bank that our Company has used for a long time. We are confident you will find them helpful and accurate.

We realize with the economy that some of you may be having financial problems. If you would like to apply for a payment plan, ALL requests must be in by March 1, 2011.

MONTHLY BOARD MEETING MINUTES - OCTOBER 2010

Pool
· Met with Brian from CSCM to go over pumps, conversion to salt, new contract.
· Signed new 3 year contract with CSCM. Contract price only went up 1.25% and is locked in for 3 years. (all board members present voted in favor)
· State Mandates: State has added that all opening that have to do with any drainage be covered to protect the swimmers. However, as of our meeting today, the state has not released the guidelines how to cover them. Once Brian receives guidelines, he will contact board to discuss time and confirm pricing. Discussed covering walls in pump room with plastic type board to protect.
· Discussed the idea of turning off pumps for the winter. Currently we have 2 5hsp motors and they only have two power options, off or 100% on, there is not a variable speed option on current motors. Discussed turning the pumps off to conserve energy. Not a good idea due to the fact that the pool is not covered, (cost of cover 10k to 15k). Possibilities if pump is turned off: staining pool green, cost of chemicals to clean pool, having to completely drain pool to clean (100k gallons). At this time the board voted (All board members present voted in favor) to keep the pumps running until a decision is made rather or not to replace pumps and/or convert to salt.

Audit Update
· Jack Goldstein (Partner) and Nancy Pezold (Audit Manager) met with the board to bring us up to date and to ask a few questions for their clarification in order to complete the audit. The audit should be complete in about 3 to 4 weeks with a draft copy going out prior to final print.
· Assessment: All but $5,000 has been collected for the special assessment. GREAT!
· LM currently has more the 15 liens in place on homes regarding late fees, fines, and non-payment of HOA dues. There are currently 51 homes that owe LM money for one or all of the above mentioned items for 2010. Of the 51 homes, 9 have an outstanding balance of $1,000 or more which represents 57% of the $26,688 owed to LM. 14 homeowners are on payment plans.


· Late Fee's for 2011: Board voted (All board members present voted in favor)
A one time late fee of $40.00 will be assessed to the homeowner if their dues are not received by 3/15/2011.
Regular dues are due on 3/1/2011 and considered late if not received by 3/15.
If a homeowner calls Superior Management and sets up a payment plan prior to 3/1/2010, late fees will not be assessed.

Social Committee
· Garage Sale this weekend.
· Need more volunteers!! One current member is moving at the end of the year.
· Fall Festival planned

Community Watch
· No new news

Fall Projects:
· Signs, sprinkler system, front and back entrances.
· Board voted ((All board members present voted in favor)) to request bids from contractors to help with updating our entrances. Once bids and plans are in, decision will be made who to use and what to do. The board is not paying for bids.
· Dead Willow tree will be removed by Timber Hill Tree Service, stump ground and cedar tree trimmed up 4 to 5 feet at the park. (All board members present voted in favor)
· Architecture Committee: (All board members present voted in favor) to add Bill, Patrick and Frances to committee in order to improve turn around time on requests. Residents can now drop information into either of the committee member's boxes.

COMMUNITY UPDATE - FROM YOUR BOARD OF DIRECTORS

We would like to take this time to update Landen Meadows residents on a few items the board has been working on this year. Our great neighborhood is close to twenty years old and many of our common areas and neighborhood amenities are starting to show their age, in particular the tennis courts, pool house, cabana and our entrances.

By now you should have received your letter outlining the assessment. We have received some thank you emails as well as emails against the assessment. Please understand that we are very aware of the economy and the impact it has had on all of us. With that being said, the board purposely waited until a couple of weeks ago to send out the letters letting you know that the assessment had passed with a majority vote. We also made the decision not to ask for any money prior to our annual homeowner dues and income taxes being due. The board has set up a payment plan for each homeowner but keep in mind if you need more time or have a special situation, please feel free to contact any board member or Bumgardner Association Management. All of your requests will be kept confidential. As we move forward with the collection of the assessment, we will be able to provide you with a timeline of the work to be completed. The board would also like to thank the volunteers who took their time to obtain signatures. With out your dedication to your neighborhood this would not have been possible.

We would also like to acknowledge and thank the many residents who send us emails or call us regarding areas of concern throughout our neighbor hood. It is nice to have more eyes helping a small set of volunteers keep our neighbor hood a great place to live. While it may seem nothing is being done immediately to resolve obvious violations of the covenants by various homeowners, please understand we work with all homeowners according to specific guidelines to bring resolution to those issues. Due to changes in the some of the laws, there are processes we must follow and this sometimes can be time consuming.

As we all are getting out more, take the time to pick up that piece of trash in the road, at the park or in the parking lot. If we all do a little it will make a big difference.
Over the next couple of weeks, you will notice work being done on our pool house and cabana. We are replacing the roof on both the pool house and cabana with architectural shingles, removing rotten wood, siding, and painting. We took six bids from contractors and by doing so were able to save quite a bit of money for the same work. All of the work comes with warranties from the contractor along with the manufactures warranties on some materials. We will also be installing commercial grade 24 hour surveillance cameras around the pool and tennis court areas. A special thank you goes to Mike Halloran for the donation of the equipment and his time as well as thank you to Randy Kossler for his efforts and expertise with the installation. The work should be completed very soon as weather permits. Additionally Mike Halloran donated metal and wood shelving for the storage room at the pool and installed them himself. Thank you Mike!

RE: COMMUNITY ENTRANCE LIGHTING

The board is working with a resident electrician to rectify the entrance lighting problem at the community entrances. We are exploring cost effective methods to avoid any repetitive issues. We hope to have all lights in working order as soon as possible and apologize for any inconvenience.

VANDALISM & BREAK-INS AT THE POOL FACLITIES

Due to recent break-ins and vandalism at the pool, the board has decided to replace the existing chain link fence with a more secure option. A black, anodized aluminum fence will be installed over the next several days. In addition, new lighting will be installed as well. It is our hope that this will deter future break-ins.

SUBJECT: Agenda for the 2008 Annual Meeting of the Landen Meadows Homeowners' Association


Dear Neighbors:
As the year comes to a close, we on the Board are busy preparing for the 2008 Annual Meeting and felt that it was important to let you know some of the things that will be on the agenda for vote by the residents of the neighborhood.

In the last year, the Board has had to deal with the question of commercial vehicles being parked in the driveways and streets of Landen Meadows against the specific terms of the Covenants, Conditions & Restrictions that we all agreed to be bound to by when we moved to the neighborhood. One of the most difficult issues that the Board had to deal with was just exactly what a "Commercial Vehicle" should be defined as. After research and consultation with various attorneys, the following definition of a Commercial Vehicle is being proposed for adoption by the Board. A Commercial Vehicle is defined by any of the following criteria:

1. A vehicle that has a weight capacity of 3/4 ton or more and has a utility box for the back bed and side panel cabinets;
2. A vehicle that has commercial tags;
3. A vehicle that visibly stores materials and/or equipment on it;
4. An 18-Wheeler cab or rig;
5. A box truck (i.e. UPS or Ryder Truck);
6. A vehicle with racks exceeding 8 ft. in height; and
7. A vehicle with advertisement exceeding 4 sq. ft. of writing not designated in one discrete area (i.e. the door panel).

It is the Board's hope that this will help to clarify the issue and prevent future conflicts.

The primary issue facing Landen Meadows, and the one the Board has spent the most time on of late, is the current state of the Common Areas and the need for repair and/or replacement of various items listed below:

1. Complete demolition and replacement of the existing Tennis Courts. After consultation with various contractors, it has been determined by the Board that a
simple re-surfacing of the Courts is not a realistic option. Therefore we have requested a bid from Carolina Courtworks to completely demolish, re-grade, and
reinstall the Tennis Courts. Estimated cost: $48,000.00
2. Repair/replacement ofthe existing sprinkler system around the Pool/Playground/Tennis area. Due to issues with the existing system, it has been recommended to the Board by the various contractors from whom a bid has been requested that a completely new system be installed. Estimated Cost: $8000.00
3. Installation of a new sprinkler system at the Tamarron Drive entrance to the neighborhood to match the system at the Rea Road entrance. Estimated Cost: $1,400.00
4. Installation of wrought iron "Neighborhood Information Signs" at each entrance to the neighborhood. These would be similar to those in the Sardis Woods neighborhood. Estimated cost: $2000.00
5. Installation of a new "Pool Deck" next to the existing cabana area in order to increase available seating area during busy days at the Pool. Estimated Cost:
$4,500.00
6. Replacement of the existing wooden fence around the Rea Road entrance with a wrought iron and brick fence similar to that located at the Tamarron entrance.
Estimated Cost: $8,000.00
7. Replacement of the existing cyclone fencing around the Pool Area with a black, anodized aluminum fence similar to that in the Raeburn neighborhood. Demolition and installation will be done by Champion Fence Builders. Estimated Cost: $12,000.00

TOTAL ESTIMATED COST: $83,900.00

The Board feels that the improvements/repairs delineated above are necessary in order to keep the amenities package and appearance of Landen Meadows up to par with that of the surrounding neighborhoods. Charlotte has been in the national news recently due to our city's bucking of the national trend of declining property values. That having been said, houses are taking longer to sell and it has definitely become a "Buyer's Market". We as Board Members and homeowners in Landen Meadows feel that it is critical that we do what we can to help maintain and improve the desirability of our neighborhood versus those around us.

In order to finance the capital expenses that are listed above, the Board has decided to ask the Homeowners of Landen Meadows for permission to levy a Special Capital Assessment for the fiscal year of2008. This Assessment will be in the amount of$300.00 per house, due by July 1, 2008. It is the earnest hope of the Board that upon collection of the Assessment we will be able to complete the improvements listed above and begin the establishment of a more substantial reserve fund for future ongoing deferred maintenance of the common areas.

We as Board Members realize that many of you will have questions on the issues that we have raised. To that end, please feel free to contact us at the following email address with your concerns. (lmhoa@Iandenmeadows.org) The Board will also be going door-to-door over the course ofthe next 30 days to answer questions and actively request your proxies to vote in favor of the proposed assessment.

APPROVED BRADFORD PEAR REPLACEMENTS
The following trees have been approved by the Board as replacements for the Bradford Pears. If you wish to replace with a tree other than on the list below, we would request that you obtain Architectural Committee approval.

- Red Maple - October Glory, Red Sunset or Trident Maple
- Oak Tree, ANY OAK.
- River Birch, Must be 10-12' Tall when installed
- Cherry Tree, Yoshino or Khwanzan
- Purple Leaf Plum 10-12' when installed.

SPEEDING. Homeowners are asked to be on the lookout and report speeders to the Police Dept. immediately as they are endangering both lives and property. Please help us to keep the community safe.



NO TRESPASSING. Signs have been installed at the Tennis Courts, Pool, Playground and Basketball courts, specifying no trespassing after close. Due to recent vandalism, the Charlotte Mecklenburg police department will be patrolling these areas. Anyone found on these premises after close will be arrested. Parents, please make certain your children are aware of this change.

REA ROAD AT OUR BACK DOORS. With the opening of Rea Road extension, the back side of Landen Meadows is now in view. To maintain the overall loveliness of our community, all houses abutting Rea Road will need to have their backyards maintained in the same manner as their front yards. If uncertain as to these standards, please refer to the Landen Meadows covenants. Violations will be recorded and fines may be levied.

WALK THROUGHS. The Architectural Committee members will be walking through the neighborhoods. Please remember to request authorization before beginning any outdoor projects. Any member of the Committee will be happy to talk to you or drop off a form.

GARBAGE AND RECYCLING BINS. In consideration of visitors to our neighborhood, and those who are selling their homes, please do not put out your yard clippings, garbage bin, and/or recycling bins in the street for Monday pick up before 5:00 p.m. on Sunday. See our Architectural Page for more details.

LITTLE SWIMMERS. All non-toilet trained children MUST wear rubber pants when in either pool. "Swimmies" diapers are not sufficient. You may purchase the rubber pants at the pool - Please see a Life Guard. Unfortunately, we've had several incidents forcing the closing of the pool, which is closely controlled by the Board of Health.
